Terms & Conditions

I desire to participate in a Kundalini Activation Light Integration (KALI) session, Shamanic Extraction Healing session, Cacao Ceremony, or Kambo Ceremony (herein referred to as the "Activities") at a yoga studio, other location, or retreat facility.

 

I understand that the Activities are complementary energy-based approaches to health and healing that can assist my body in its natural ability to heal. I fully acknowledge and understand that this is accomplished through the use of contact and/or non-contact touch.

 

The Activities are generally considered safe, though given that they are such powerful transmissions, please be aware that they can sometimes release unprocessed emotions. This is a vital part of the process, and we recommend giving yourself time afterward to support integration. The Activities are not advised for people prone to manic, delusional, or psychotic episodes.

 

I understand that the Activities are complementary therapies not intended to replace any currently prescribed medical treatments, as ordered by my physicians, or any other medical care that I may be advised to seek by them.

 

I understand that Evelin Daey, or any KALI facilitator, will neither diagnose nor prescribe for any medical condition I might have nor does she make any specific claims regarding results from the Activities I receive. I understand that I am encouraged to consult a licensed medical practitioner for any physical or mental complaints. The Activities is not a substitute for medical or psychological attention, examination, diagnosis, or treatment.

 

I understand that the Activities may involve physical movements and an opportunity for stress reduction and improved mental well-being. As is the case with any physical activity, the risk of injury, even severe, disabling, or fatal, is always present and cannot be eliminated. If I experience any pain or discomfort, I will listen to my body, discontinue the Activities, and ask for support from the facilitator. I will continue to breathe smoothly. I assume full responsibility for any and all damages that may incur through participation. 

 

Evelin Daey is unavailable or trained to assist with emergencies or urgent physical health crises. If you are having a psychological emergency, please call the L.A. County Mental Health/Crisis Line at 800-854-7771, or for a physical emergency, please call 911.

 

No one under the age of 18 will be permitted to attend Evelin Daey's classes or events without an attending parent or guardian.

 

I understand that all client information and records are treated confidentially. My experiences during these sessions are confidential, subject to the usual exceptions governed by State or Federal laws/ regulations and if there is reason to believe that you have serious intent to harm yourself by an act you may commit.

 

By signing, I affirm that a licensed physician has verified my good health and physical and mental condition to participate in such a program. In addition, I will make the instructor aware of any medical conditions or physical limitations before class or Session. If I am pregnant or become pregnant, or if I am post-natal or post-surgical, my signature verifies that I have my physician's approval to participate.

 

I also affirm that I alone am responsible for deciding whether to practice a Session, and participation is at my own risk. Except in the case of gross negligence or malpractice, I or my representative(s) agree to release and hold harmless fully Evelin Daey from and against any and all claims or liability of whatsoever kind or nature arising out of or in connection with my Session, classes/Session (s)/events.

 

We reserve the right to refuse service.

 

By attending Evelin Daey's classes, sessions, and events, you acknowledge that you have read the Terms of Use and the disclaimers and accept and agree to be bound by the terms thereof.

 

As these policies are publicly visible and available, anyone attending Evelin Daey's classes, sessions, and events does so with the acknowledgment that she/he/them/they has read the above waiver, understands its meaning and legal implications, and agrees fully to the terms and conditions stipulations herein.

 

By purchasing a class/session, you acknowledge the cancellation policy. You acknowledge that Evelin Daey is not a doctor, counselor, or lawyer. She does not provide anyone with medical, psychological, or legal advice, although Evelin Daey puts her heart and soul into helping people. This is why it is said that KALI Energy Healing, Shamanic Extraction Healing, Cacao Ceremony, or Kambo Ceremony events/ classes/sessions are for entertainment purposes.

 

We may amend these policies from time to time. Changes will be posted on our website. We encourage you to review our policies periodically, as by visiting our website, you agree to accept any such changes.

 

 

I have read, fully understood, and agree to the above terms of this Liability Waiver Agreement. I am electronically signing this Agreement voluntarily and recognize that my electronic signature serves as a complete and unconditional release of all liability to the greatest extent allowed by law in the United States and the State of Wyoming.

 

There are no refunds. To reschedule, you must give 48 hours' notice. No-shows will not be refunded or rescheduled.

 

 

PARTICIPANT AGREEMENT AND WAIVER AND RELEASE OF LIABILITY

 

 

1. Waiver and Release of Liability. I, intending to be legally bound for myself and my heirs, personal representatives, next of kin, and anyone who might make a claim on my behalf, hereby waive, release, and discharge Evelin Daey, and the SUNDAEY Organization, their officers, agents, employees, and volunteers from any and all claims for damages and/or liability, whether caused by any active or passive negligent act or omission of SUNDAEY Organization or Evelin Daey or their officers, agents, employees, and/or volunteers, or otherwise related to my participation and promise not to sue SUNDAEY Team or Evelin Daey or their officers, agents, employees, and/or volunteers for any damages I incur in connection with the Activities. This release and waiver extend to all claims of every kind or nature whatsoever, foreseen or unforeseen, known or unknown.

 

I understand that this waiver means I give up my right to bring any claims, including those for personal injuries, death, disease, property losses, or any other loss, including but not limited to negligence claims, and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen.

 

2. Compliance with All Rules.

I agree to obey all rules and regulations applicable to the Activities and instructions provided by Evelin Daey and volunteers during my participation in the Activities.

 

3. CHOICE OF LAW: I understand and agree that the law of the State of Wyoming will apply to this contract.

 

4. Miscellaneous. I acknowledge and agree that this Agreement is binding upon my heirs, assigns, and legal representatives. I agree that this Agreement is meant to be as comprehensive and inclusive as permitted by law. I further agree that this Agreement is severable and that if any clause is found invalid, the balance of the Agreement will remain in effect, valid, and enforceable. I HAVE READ THIS AGREEMENT AND WAIVER AND RELEASE OF LIABILITY, KNOW, UNDERSTAND, AND AGREE TO BE BOUND BY ITS CONTENTS, AND ACKNOWLEDGE  IT ELECTRONICALLY OF MY OWN FREE WILL.
